Riviera Rental Guide Booking Terms & Conditions
These terms and conditions govern the rental Agreement between Riviera Rental Guide and all renting parties. The Agreement is activated on completion of the booking process.
Time limits
Riviera Rental Guide do not provide an agreement unless the booking process is completed within the limits of the website.
Unforeseen unavailability
Should Riviera Rental Guide be unable to facilitate a booking reservation we reserve the right to transfer the customer to a property with similar characteristics. If Riviera Rental Guide are unable to offer a property of similar characteristics the customer has the right to cancel the contract and Riviera Rental Guide will not be liable for any further claim. Similar will be deemed to have been met by providing a property of same type, accommodation the same number of people or more, and be in the same region.
Due to the unique nature of many properties, if a similar property is not available or cannot be found, a full refund will be given. No further claim for damages can be made.
Reservation deposit
30% of the total of any reservation is required to secure a property, on receipt you receive balance payment schedule, if applicable, which must be paid within the limits specified. In the event that the reservation is being made close to check-in time, the Riviera Rental Guide system will only offer the option to pay in full.
Balance settlement
On full payment the customer receives detailed itinerary, check-in and check-out process, address and directions to the property, along with details of Riviera Rental Guide cancellation policy.
In the event of an applicable settlement period, where payment is not made within the specified time, the Riviera Rental Guide booking system will automatically cancel the booking and release the dates for alternative reservations. Failure to make payment within the specified time frame, this will be construed as a desire to cancel the reservation and Agreement, and Riviera Rental Guide's cancellation policy will apply. Damage and utility deposit
On arrival at the rental property, it is common that a damage deposit will be required at check-in. The details and the manner of how this deposit will be paid and any applicable amounts can be found in the property rates sheet. In the event that no damages occur, any damage deposit paid will be returned in the manner specified by the check-out process, which is detailed in your detailed itinerary email.
Internet connectivity
Riviera Rental Guide have a number of properties which specify that an internet connection is available. The customer acknowledges that Riviera Rental Guide have no control over the quality or level of service provided by any internet service providers (ISPs). Riviera Rental Guide are not responsible for any connectivity problems resulting from software/hardware compatibility.
Cancellation policy
Riviera Rental Guide operates a cancellation policy which depends on the number of days in advance of the check-in time that cancellation notice is given. The cancellation policy applies in all circumstances including force majeure.
Cancellation insurance
It is a condition of this booking that you acknowledge Riviera Rental Guide's recommendation that every booking is covered by adequate cancellation insurance.
Please remember a reservation is a legal contract. We strongly recommend you ensure you are adequately covered by cancellation Insurance for your rental.
Our properties are extremely valuable and the private owners are unable to risk the loss of customer and income due to cancellation.
More than 90 days notice
You are liable for 30% of the total booking value.
Less than 90 days
You are liable for 100% of the total booking value.
In certain locations, notably the French Riviera, cancellations are covered by our tailored insurance product. Your insurance contract, which is available in your customer account shortly after booking, will cover the cancellation of your holiday in the event of:
a) serious illness, serious injury or death of any named member of your group
b) loss to your main residence, secondary residence or business premises caused by theft, fire, water damage that necessitates your presence during the course of your holiday
c) redundancy
d) certain transport events
e) certain public health events
f) judicial subpoena
g) unforeseen unavailability of the accommodation
h) denial of visa application
i) identity theft
j) theft or attempted theft of your vehicle
k) forced holiday date change by your employer

In the event that you wish to amend your booking details, it is understood that it shall be deemed a new reservation and become subject to the cancellation policy as detailed above.
For properties reserved for special events including but not limited to the Cannes Film Festival, the Monaco Yacht Show, Voiliers de St. Tropez, Monte Carlo Grand Prix and other top line events, you will be liable for the full amount of the booking should you cancel regardless of the notice period. Your booking is conditional on you securing adequate insurance to cover potential cancellations.
Travel Insurance
It is a condition of this agreement that each person staying in any Riviera Rental Guide property be covered by travel insurance that specifically covers their use of a rental property, and any liability they may face as occupants resulting from actions caused by any member of the party, to the property, persons or other unknown damages and claims.
Check-in process
It is imperative that you arrive at the property at the time that you specified at the time of booking. In the event that your check-in time changes, you must notify Riviera Rental Guide without delay so that the impact on the check-in process is minimal. Please note that check-in can not be accommodated beyond the hours specified in the property listing and Riviera Rental Guide will not be liable for any associated costs.
Check-in security
Your booking reference number must be provided at check-in to gain access to the property, failure to provide the booking reference number may result in the party being unable to check-in.
Failure to adhere to the check-in process as specified in your detailed itinerary may result in being unable to gain access to the property.
You must contact Riviera Rental Guide immediately should there be any discrepancies in the property inventory or any other problem that becomes apparent so that it may be noted and rectified.
Check-out process
You understand that the property will be cleaned prior to your arrival and that it is incumbent upon you to leave the property in a similar condition. Upon review of the inventory, the damage deposit will be returned less any monies due. The damage deposit will not be retained other than for outstanding utility bills, outstanding payment, additional charges incurred or damage to the property.
Failure to adhere to the check-out process as specified in your detailed itinerary may result retention of damage deposit.
Keys
It is a criminal offence to make unauthorised copies of keys, should you require additional key sets, they can be requested at check-in time.
Number of guests
The maximum number of guests that each property can accommodate is clearly stated, it is forbidden to exceed the number of stated guests, unless express arrangements are made in advance with Riviera Rental Guide. Additional payment may required in this instance. This excludes infants under 2 years in cradles or carry cots.
Special Events
Any customer intending to hold any kind of special event such as weddings, fashion shows, film sets, TV reporting, product launches, large parties and any event involving more than the specified maximum number of people at any property must have advance explicit permission from Riviera Rental Guide.
Mechanical failure
No refund or rate adjustment shall be made for unforeseen mechanical failures such as the supply of electricity, water, pool filtration systems, air conditioning, hot tubs, whirlpools, television, cable service, internet connection, satellite television, appliances, etc. Clients should attempt to deal with problems on the spot through their check-in contact.
Maintenance access
Staff may be required to enter your property to perform maintenance or repairs as necessary. They will make every effort to schedule these visits at a time convenient to you, to respect your privacy, and not interrupt your stay.
Liability
Riviera Rental Guide is not liable for losses incurred through circumstances outside the control of the company. This includes but is not limited to the closure of swimming pools, bad weather conditions, war, riot, disturbance, traffic congestion, nearby building works, transportation strikes, travel delays, burglary, theft and anything that causes a loss of enjoyment of the reserved facilities.
Pets
Pets are not permitted except in properties where it is explicitly stated that pets are permitted.
Behaviour
The person providing their contact details at the time of booking shall be liable for the good behaviour of all guests in the party. Should any of the aforementioned engage in anti-social or disruptive behaviour at any time over the duration of the booking, it will be construed as a breach of the Agreement.
Safety liability
Riviera Rental Guide shall not be liable direct or indirect personal injury, claims or damages if the customer disables or deactivates or fails to utilise any safety systems available on the property, including but not limited to; swimming pools safety devices, alarm systems, smoke alarms, physical barrier systems, locking procedures,
Breach of Terms and Conditions
Should the customer be in breach of these terms and conditions, Riviera Rental Guide will be entitled to terminate the Agreement without delay and request immediate vacating of the property. In this instance Riviera Rental Guide will not be liable for any associated costs or further claims by the customer and the customer will forfeit any damage deposit and prepaid rental.
The Riviera Rental Guide Website
All property descriptions, features and images are supplied by the appointed representative of the individual property concerned. Whilst Riviera Rental Guide do their utmost to ensure the accuracy of this information and while Riviera Rental Guide checks the details wherever possible, the company cannot be held liable for any discrepancies. However, should you encounter any discrepancies you are bound by this Agreement to contact us immediately.
All geodata and it's derived information such as amenity location and distances is supplied by Riviera Rental Guide or it's affiliates and whilst we do our utmost to ensure the accuracy and integrity of this information it should be used as a guide and for illustrative purposes only and we cannot be held liable for any inconvenience caused through any unlikely error, omission, use of this data.
The Riviera Rental Guide directory is supplied as it as a database of local businesses and services which may be of benefit to the customer. Riviera Rental Guide does not accept any liability for the content or the quality of any products or services offered by these third party companies. Riviera Rental Guide recommends reviewing the Terms and Conditions of these third party websites.
Interpretation of Agreement.
If any part of this agreement is determined to be invalid or enforceable under applicable law, including, but not limited to, the disclaimers and liability limitations set out above, then the invalid or enforceable clause shall be construed as superseded by a valid, enforceable clause that most accurately reflects the intent of the original clause, and the Agreement shall continue in effect.
Governing Law
This agreement is governed by the laws of the Republic of Ireland.
Remedies
In the event of a dispute between you and Riviera Rental Guide, you agree, as a condition precedent to your filing of any legal action or administrative complaint, that you will participate in good faith in voluntary mediation of such dispute in Dublin, Ireland, under the common mediation rules of the country of Ireland.
Riviera Rental Guide's performance of this agreement is subject to existing laws. Nothing contained in this agreement shall interfere with Riviera Rental Guide's right or obligation to comply with requests or requirements of law enforcement agencies relating to your use of this Web site or to information provided to or gathered by Riviera Rental Guide with respect to such use.
Release and Indemnification.
By reserving through Riviera Rental Guide, you expressly agree to release, hold harmless and indemnify Riviera Rental Guide and its suppliers, and their respective members, officers, directors, employees and agents, from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind, including but not limited to, payment of reasonable legal and accounting fees, brought by you or on your behalf in excess of the liability described above, or by third parties as a result of your breach of the Website Terms and conditions and/or the Terms and Conditions of renting a property and the notices or documents referred to herein either your violation of any law or the rights of a third party or your use of this Website.
These terms and conditions do not affect your statutory rights.
** Notes on cancellation
Although rentals are not covered under the law, as a courtesy you may cancel up to 7 days after you have made the booking only if you have reserved and paid by bank transfer. If you have paid by credit card the contract exists.

Contracts to which only part of these Regulations apply
(2) Regulations 7 to 19(1) shall not apply to—
(b)contracts for the provision of accommodation, transport, catering or leisure services, where the supplier undertakes, when the contract is concluded, to provide these services on a specific date or within a specific period.
(3) Regulations 19(2) to (8) and 20 do not apply to a contract for a “package” within the meaning of the Package Travel, Package Holidays and Package Tours Regulations 1992(2) which is sold or offered for sale in the territory of the Member States.
